Overseas Insolvency Practitioners
We are aware that firms of Insolvency practitioners outside the United Kingdom (UK) may be instructed to deal with Groups of Companies which have a subsidiary company based in England, Wales, Scotland or Northern Ireland that may be insolvent and in such situations they may not have the necessary Insolvency License or the knowledge of UK insolvency legislation to deal with the UK resident company. We have experience of working with foreign Insolvency practitioners and are able to work effectively together to obtain the best results for the creditors as a whole.
Overseas Insolvency practitioners involved in restructuring work may need to deal with the disposal of solvent UK Companies which could form part of an overseas group which is insolvent as a whole. We are able to assist in such situations by using our Corporate Finance team who regularly deal with the sale of solvent Companies. In addition if a foreign parent has a solvent UK subsidiary which they can no longer support we can also advise on a solvent wind down of the business at the minimum cost to the parent.
We have experience of migrating an entity’s Centre of Main Interest to the UK to enable UK legislation to be used to create additional options to deliver the best return to creditors. In particular we have used this technique to enable German Companies to take advantage of the Company Voluntary Arrangement procedure which has no equivalent under German law.
In addition overseas insolvency practitioners may have estates which are owed significant sums by UK debtors and we are well placed to negotiate settlements on your behalf.
Overseas insolvency practitioners may also be instructed by companies or individuals who owe money to and are being pursued by UK companies or individuals. We can advise on this situation.
As a firm we are completely independent and have no formal associations with any other firms and as a comparatively young firm without an audit or tax practice rarely encounter any conflicts of interest which prevent us from accepting an appointment.
